Am I Able To File For Diasability While Going Through My Reconstructive Surgery?

Even though cancer is a condition you can file for disability for, I think you have to be out of work over a year.

You can, I took 5 weeks off and filed for short term disability.

Yes. I filed on my own and was declined. I have a SSI disablity lawyer I am working with. Sadly, anyone under 50 is like almost and automatic denial. Some SS lawyers will take your case and only will be paid should you win. for Ex, the person I am speaking to takes 25% or $6000 max , whichever is greater. Disability is retroactive from teh date of your Dx, not when you file.

I too live in California .. I went on leave from work November 23, 2013.. Filed for disability for my year of treatment at which time disability ran out December 2014. I returned part time back to work for 3 weeks That was JANUARY 2015... Went back out in Fwbruary 2015.. Filed for Disabilty again for 3 month recovery related to my reconstruction surgery. It was granted because I went back to work without restriction and made more then $300.00 while at work for those 3 weeks. I did lose about $1000.00 a month compared to my last disabilty claim but that's because they took into account the month of January that I had worked. I am also going to be asking for an extension b a use of complications from my recent surgery. so YES you should be able to get disabilty .
