Complex question. Review labor law in your state. FMLA application, size of company, etc. Gather information and ask questions, don't sit back and wait for them to do something to you, be prepared with information to make your case for yourself.

That's a complicated question, Jo. If you were on FMLA and used up your time, it's possible. That happened to a friend of mine recently for a different health issue. Plus there's pto, sick days. etc that might come into play. You might want to look into this further and get a free attny consult. Also, look into unemployment benefits. Hope this helps.

Under the Family Medical Leave Act (FMLA), companies with 50 or more employees, public schools, and public agencies must grant employees up to 12 weeks of unpaid time off each calendar year to deal with illness, including breast cancer. This leave offers job protection, meaning your employer cannot legally terminate you solely because you are on FMLA leave. However, it's important to communicate regularly with your employer and provide as much notice as possible when changes occur.
